THE Brothers + Sisters Crystal City PEOPLE'S INFORMATION SHEET [in margin] This was given out to mob students during campus riot - copy of that used at riots in Wash. D.C. and all the way in California PREPARATION FOR A DEMONSTRATION A violent police riot is always a possibility. Cops are scared of us in demonstrations. Take these minimum precations for your own safety. Wear pants. and don't wear earrings. Wear hard shoes. never sandals. Don't wear glasses unless it is absolutely necessary. and then secure them with a rubber band No contact lenses or false teeth If knocked out you can choke on your teth. If maced or gassed. lenses can erode the cornea and even cause blindness Long shirts with high collars and tight cuffs can protect against gas attack. Wear a belt which can be used as a tourniquet. Some sort of head protection is available; a helmet liner costs about fifty cents in any army surplus store. is light and can protect your head against a club Notheing should be worn around the neck. Bring a pair of plastic goggles, which will protect your eyes from both tear gas and Mace, and will fit over your glasses. (Use glycerine or "Fog-Off" to prevent fogging up Bring a handkerchief or surgical scrub face-mask available in a drug store) to use over a wet 4x4 sterile gauze pad to protect against gas. Do not rub your eyes after being gasses or Maced--or wash them with soap; this can aggravate irratation. Instead, irrigate your eyes by squeezing water from cotton balls on them and them clean your eyes with over-the-counter eye drops Get the gas off your skin by wiping with mineral oil, or flood the skin with alcohol. Remove all clothing saturated with gas, Put vaseline on your face as protection against Mace. Remove it immediately after you are Maced. Vaseline prevents burning by Mace for a short time only and if it is not removed you can be seriously burned. If you have any known illness carry identification cards or tags. For example, I am a diabetic on insulin or I have penicillin allergy. Carry a supply of medication you take. Although these medicines may be confiscated a Movement doctor or lawyer can often get them back and/or you may successfully sue the cops Be sure you've had a tetanus toxiod shot within the past five years. Tetnus from street wounds can be serious and shots provide full protection. Never take your address book to a demonstration If you are arrested cops will get everyone's name. Never carry a pen*knife or nail File to a demonstration. You can be charged with posession of a dangerous weapon if you get busted. Demonstrations are seldom peaceful. Police riot people try to take over the streets--since there is never clear central leadership when people are running in the streets. It is important to get a small group of friends and move with them at all times. If you are alone you will have much more trouble deciding what to do. A cop doesn't have to say "YOU ARE UNDERARREST' IN ORDER TO ARREST YOU: HE CAN you or INDICATE IN SUCH WORDS AS "LETS GO" THAT YOU ARE ARRESTED HE DOES NOT HAVE TO ARREST YOU TO PUT YOU IN HIS CUSTODY; HE CAN DETAIN YOU. HE HAS A RIGHT TO HOLD YOU FOR SEVERAL HOURS UNDER WHAT HE CONSIDERS "SUSPICIOUS" CIRCUMSTANCES AND THEN RELEASE you. REMEMBER, AS SOON AS A COP DETAINS YOU, EVEN IF HE MAKES NO FORMAL ARREST, YOUR RIGHTS APPLY--AMONG THEM, THE RIGHT TO BE SILENCE. RESISTANCE AND ESCAPE AN ARREST IS LEGAL IF THE COP HAS REASON TO BELIEF TAAT YOU COMITTED ANY CRIME, IN HIS PRESENCE OR THAT YOU COMMITTED A SERIOUS (FELONY) CRIME IN OR OUT OF HIS PRESENCE, i.e., IF THE CRIME IS A FELONY, THE COP NEED NOT HAVE OBSERVED YOU COMMITTING IT; IF IT'S A MISDEMEANOR HE MUST SAY HE WITNESSED IT. A JUDGE WILL USUALLY BELIEVE THAT THE COP HAD REASON TO ARREST YOU EVEN IF THE CHARGES AGAINST YOU ARE DISMISSED OR YOU ARE ACQUITTED. EVEN IF YOUR ARREST WERE RULED ILLEGAL IT WOULD STILL BE A CRIME TO RESIST IT, THIS IS THE "NO-SOCK" LAW. IF YOU RUN AWAY FROM THE COP AND ARE CAUGHT YOU CAN BE CHARGED WITH AN ADDITIONAL CRIME OF "ESCAPE": HOWEVER, SOMETIMES YOU CAN ESCAPE SUCESSFULLY WITH THE HELP OF YOUR BROTHERS WHO DISTRACT THE COP BY USING YOUR OWN INGENUITY. ONE GUY FOR EX. TOLD A COP, "RELAX YOUR GRIP, I WON'T RUN AWAY". THE COP TOOK HIS ARM OFF THE KID WHO THEN DASHED AWAY INTO A CROWD. DON'T TALK WHEN YOU ARE ARRESTED you are arrested: and your scared, so you talk to the cops - DON'T TALK 1) Trying to talk yourself out of an Arrest is fruitless and you may incriminate yourself & someone else. 2. Trying to find out what you are charged with is useless at the time of arrest. You may think he has no legitimate charge but it is easy to get you on disorderly conduct, loitering, or some other minor offense 3) If you are taken to the precinct in a squad car - there is danger of harassment one of "friendly" attempts by the cops to get you to talk. DON'T TALK - you may make an admission without even realizing it. YOU HAVE A RIGHT TO REMAIN SILENT YOUR "RIGHTS": UNDER THE LAW THE COPS ARE SUPPOSED TO INFORM YOU THAT I. You have the right to remain silent. II. Anything you say can + will be used against you III. You have the right to a lowyer + to have that lowyer present at all times when being questioned. IV. If you can't afford a lawyer the state will supply you with one. THEY MUST KNOW YOUR NAME IF NONE OF YOUR FRIENDS ARE AROUND SHOUT OUT YOUR NAME SO THE PEOPLE AROUND HEAR YOU! 1) NOTICE WHO SAW YOU ARRESTED YOU MAY NEED THEM AS WITNESSES AT THE TRIAL. 2) GET THE BADGE # OF THE COP WHO ARRESTS YOU. OFTEN THE COP WHO ARRESTS YOU IS NOT THE SAME ONE WHO TESTIFIES AGAINST YOU IN COURT. IF YOU HAVE THE ARRESTING COP'S BADGE OR CAR # YOU CAN PROVE THAT IT ISN'T THE ARRESTING COP WHO IS TESTIFYING AGAINST YOU IN COURT. THIS CAN HELP YOU GET YOUR CASE DISMISSED. PLANCLOTHES OR NO-BADGE - TRY TO EVEN GET 1ST NAME. 3) NOTICE THE CIRCUMSTANCES AROUND YOU, ARE PEOPLE TRYING TO PASS YOU ON THE SIDEWALK OR TRYING TO GET INTO THE BUILDING YOU ARE BLOCKING? IS THERE TRAFFIC IN THE STREET? SUCH INFOrmation MAY PROVE USEFUL IN EXPOSING THE WEAKNESS OF THE COP'S TESTIMONY ON OBSTRUCTING TRAFFIC OR BLOCKING AN ENTRANCE TO A BUILDING. 4) WRITE DOWN INFORMATION - AS SOON AS YOU CAN. AS YOU WILL FORGET DETAILS. DON'T LET THE COP SEE YOUR PAPER OR HE WILL TAKE IT AWAY. IF HE GETS YOUR NOTES THEY MAY HELP HIM MORE IN HIS TESTIMONY. IT MAY BE WISE TO WAIT TILL YOU'RE IN THE CELL. What happens to you at the Police Station You will be "BOOKED" WHICH MEANS WRITING CERTAIN INFO ABOUT YOU + CHARGING YOU WITH A CRIME. YOU WILL PROBABLY BE SEARCHED AT SOME TIMES THEY HAVE THE RIGHT TO DO THIS AS SOON AS THEY ARREST YOU. 1) Police Arrest Record + Arrest Card For Policemen YOU WILL BE ASKED YOUR NAME, ADDRESS + OCCUPATION. YOU SHOULD ANSWER AND IT WON'T HURT YOU + REFUSING WILL SLOW THE PROCESS OF GETTING YOU OUT. HOWEVER - SOME MAY NOT WANT THEIR HOUSE SEARCHED OR THEIR PARENTS TO KNOW. THEY MAKE CERTAIN SOME ONE AT THE ADDRESS MAY GIVE WILL SAY THEY LIVE THERE. BE CAREFUL IF THEY CHECK + FIND YOU'VE LIED IT WILL PROBABLY RESULT IN THE JUDGE RAISING YOUR BAIL. 2) CR-1 form for drugs IS SUPPOSED TO BE USED ONLY IN CASES OF POSSIBLE DRUG ADDICTION. IN FACT, IT IS OFTEN USED IN SIMPLE A++ BUSTS. THE FORM REQUIRES A DESCRIPTION OF A PHYSICAL CONDITION + When asked questions LIKE "DO YOU TAKE DRUGS?" YOU SHOULD NEVER ANSWER QUESTIONS ABOUT DRUGS. LAWyers should ADVISE SUCH AN HONEST "NO"! ANSWER MIGHT BE HARMFUL. REFUSE POLITELY BUT FIRMLY TO ANSWER. TRY TO REFUSE TO SUBMIT TO ANY MEDICAL EXAMINATION AS WELL, + ANSWER NO QUESTIONS ABOUT DRUGS OR DRUG USE EVEN IF ASKED BY A DOCTOR, 3) VERA SUMMONS: SOMETIMES THE COP WILL GIVE YOU THE EQUIVALENT OF A PARKING TICKET, RELEASING YOU IMMEDIATELY + REQUIRING THAT YOU APPEAR IN COURT THE NEXT DAY THIS SUMMONDS IS AVAILABLE FOR ALL VIOLATION AND NON SERIOUS, NON-DRUG-RELATED MISDEMEANOR. YOU HAVE A BETTER CHANCE OF GETTING OUT ON A SUMMONDS IF A LAWYER COMES TO THE STATION HOUSE. IF YOU CAN'T GET A LAWYER TO COME TO THE STATION HOUSE AND IF THE COPS DON'T MENTION THE SUMMONS, ASK "CAN I GET OUT ON A SUMMONS?" MAKE SURE YOU GIVE A VERIFYABLE ADDRESS. PERSONAL INFORMATION WILL BE REQUIRED IT MAY NOT BE WORTH THE HASSEL. IN ADDITION: TO ASKING THE QUESTIONS ON THE FORMS. THE COPS WILL QUESTION YOU ABOUT WHAT YOU DID. THEY MAY PRETEND THEY ARE QUESTIONING YOU FROM THE FORM. DON'T BE TAKEN IN. DON'T ANSWER ANY QUESTIONS EXCEPT THOSE DEALING WITH NAME, ADDRESS, AGE OCCUPATION - CONVICTIONS. After the Forms HAVE BEEN FILLED OUT: FELONIES OR DRUG RELATED OFFENSES OR A FEW OTHER TYPES OF OFFENSES, they WILL PROBABLY TAKE YOUR PHOTOGRAPH (MUGSHOT) AND YOU FINGERPRINTS. THESE GO TO the FBI AS WELL AS TO THE STATE + CITY AUTHORITIES. SINCE MANY PRECINCTS DON'T HAVE FACILITIES FOR MUGSHOTS YOU MAY BE TAKEN TO ANOTHER STATION FOR YOUR PHOTOS. DISORDERLY CONDUCT - INTENT TO CAUSE A PUBLIC INCONVENIENCE, ANNOYANCE, OR ALARM, OR RECKLESSLY CREATING A RISK THEREOF. 1) HE ENGAGES IN FIGHTING OR IN VIOLENT TUMULTUOUS, OR THREATENING BEHAVIOR. 2) HE MAKES AN UNREASONABLE NOISE 3) IN A PUBLIC PLACE HE USES OBSCENE OR ABUSIVE LANG. OR MAKES AN OBSCENE GESTURE. 4) WITHOUT LAWFUL AUTHORITY, HE DISTURBS A LAWFUL ASSEMBLY OR MEETING OF PERSONS. 5) HE OBSTRUCTS VEHICULAR OR PEDESTRIAN TRAFFIC. 6) HE CONGREGATES WITH OTHER PERSONS IN A PUBLIC PLACE + REFUSES TO COMPLY WITH A LAWFUL ORDER OF THE POLICE TO DISPERSE. 7) HE CREATES A HAZARDOUS OR PHYSICALLY OFFENSIVE CONDITION BY ANY ACT WHICH SERVES A LEGITIMATE PURPOSE. DISORDERLY CONDUCT IS A VIOLATION. MAX SENTENCE IS 15 DAYS +/OR $250 |
